I. Under current rules for federal prosecutors, however, “the death penalty may not be sought, and no attorney for the Government may threaten to seek it, for the purpose of obtaining a more desirable negotiating position.”
II. On May 19, 1950, the AEC had furnished the FBI with the conclusion that Fuchs had provided the Russians with “very important information concerning weapons, and with regard to the Trinity (plutonium implosion) type weapon it was concluded that the essentials of the bomb in adequate detail were turned over either while Fuchs was at Los Alamos or later.” On June 15, a hand-delivered memo from J. Edgar Hoover to the State Department provided more from the Fuchs debriefings: “Fuchs said that he would estimate that the information furnished by him speeded up by several years the production of an atom bomb by Russia because it permitted their scientists to work primarily on the development of fissionable material in view of the fact that the method of detonation was available to them.
III. The prosecution wasn’t plotting strategy in the dark. One source, which the government itself considered of “unknown reliability,” provided some of the foundation for that strategy. He told the FBI that Julius was worried that any sentence “would be a severe blow” to Ethel and that she “might break down” if Julius was sentenced to death. The informer offered another insight that would later color the government’s view of Julius’s resolve: He flatly rejected the possibility of being traded to the Soviets for an American spy and prohibited his lawyers from doing anything else that would “compromise their position.”
